A challenge from Nigel

I HAVE seen the CaRT response to Allan's article which you have published, which is remarkable for the fact that it contains no direct refutation of the allegations I have made, writes Nigel Moore.

They have, in the press releases both on their own website and yours, relied solely on the comment by deputy judge Thornton, which itself had reference only to DeVere's claim and evidence, not to mine. They have not stated, on their own responsibility and volition, any denial of the alleged facts.

Public statement

I challenge CaRT to now do so: to issue a public statement to the effect that they have reviewed the evidence for themselves and questioned the responsible officers, and can confirm from their own investigation that their original solicitors were right to assert before both Registrar and Adjudicator that the document they had been given

a) was a true copy of the original unaltered document, and

b) that it did indeed establish British Waterways' ownership of the hatched area.

The statement should be signed by the Chairman; the CEO; the Legal Director; the Property Director, and British Waterways' London's Estate Manager.

Examine the original

Following publication of this statement, they should allow Allan, myself, and a few select interested/disinterested parties to examine the original Terrier map and take good copies; examine the original of that which had been sent to Wright Hassall; interview those responsible for producing the version sent to Wright Hassall; interview those directly responsible for instructing both Wright Hassall and TLT Solicitors, and take copies of the written instructions to those solicitors reference the matter.

If I am satisfied following that, that no wrong-doing took place, I will issue a public apology on whatever public forum they designate.

Can I say fairer?

Addendum

Allan Richards has told us he would be happy to accompany Nigel, and if he is satisfied there has been no wrong doing then he will apologise for publicising his allegations.

He added that he brought these matters to Richard Parry's attention some three weeks ago.
