CaRT Court Orders and Judgments

WE ARE told that the policy of Canal & River Trust is to publish all Court Orders on its website, but not detailed Court Judgments, and we have received a statement from its Chief Executive, Richard Parry, confirming this:

"The Trust's policy—which we consistently apply—is to publish all Court Orders on our website so others can see them, and we did this in the Mayers case in February 2014. As a general rule we don't publish the detailed Court Judgments on our site because they typically include details on the individual concerned.

"The Judgment in the Mayers case was wholly in the Trust's favour. In his remarks, the Judge made it clear he was offering only a very limited view, in passing, on the Trust's ‘Guidance For Boaters Without A Home Mooring' that were irrelevant to his decision; he also insisted that the Judgment must not be selectively quoted so as to give a misleading impression. Our Guidance continues to apply as the Trust's understanding of the law and we will continue to take action where we believe boaters are not adhering to the rules, which are there for everyone's benefit."

It has been confirmed that the 63 boats that narrowboatworld stated were being dealt with for not abiding by the rules are all still in the enforcement process (at different stages).
