The current problems with cyclists reminds me of several 'damages' cases that I have been connected with over the years.

The fact that this possible hazard has been clearly outlined to BW, and they take no steps to correct it, makes them potentially liable for serious damage claims should injury arise.

There was an incident in Sussex near where I lived where a cycle lane had been marked on the pavement in front of a bus shelter. It was notified on several occasions that people could step out to flag down a bus and not hear an approaching cyclist.

When an injury did occur it was proved negligence as the council were aware and took no steps to act upon it. This would appear to be the case with BW. A potential injury/fatality situation has been notified to them on many occasions, and no action is being taken. I think a court case at some point may cause them to rethink this policy, but sadly someone will suffer first.
